POST THE DAMN THING

Terms & Privacy

I. Terms of Use

Section 1. Who we are & scope

  1. Post the Damn Thing is a website and course brand presented by Katie Love and operated by Love Social Media, a Florida entity (“we,” “us,” or “our”). These Terms govern this website and its waitlist. The Privacy Policy below explains how we handle personal information. Contact us at hello@postthedamnthing.com for questions, notices, or privacy requests.
  2. Submitting the waitlist form signifies agreement to these Terms and a request for the emails described in Section 3 below. The Privacy Policy is a disclosure of our practices, not a waiver of your rights. These Terms do not replace separate terms presented for a future purchase, course enrollment, or other service.

Section 2. Eligibility & the waitlist

  1. The waitlist is intended for people 18 and older. Submit an email address you control and accurate information. Do not enroll someone else without their permission or impersonate another person. We may decline or suspend access for abuse, unlawful use, or a material breach of these Terms, subject to applicable law.
  2. Joining is free and creates no purchase obligation. It does not reserve a course place, price, discount, release date, or access right. Descriptions, availability, and launch plans may change. A countdown or calendar reminder is an estimate of our planned launch, not a guarantee. Any later purchase is governed by the terms and disclosures shown at checkout.

Section 3. Email & promotional materials

  1. If you submit the waitlist form with its email preference selected, you request Katie Love and Love Social Media’s welcome message, course launch announcement, and related course, personal-brand education, offers, and promotional updates. Frequency may vary. No SMS, telephone marketing, or unrelated third-party marketing permission is requested through this form.
  2. You may withdraw your email preference at any time using an email’s unsubscribe link or by contacting hello@postthedamnthing.com. Unsubscribing is free. We retain limited suppression information to honor your choice. An email already in delivery may still arrive. Necessary responses to your own inquiries or legal notices are distinct from promotional subscriptions. We obtain additional permission when applicable law requires it.

Section 4. Intellectual property

  1. The site’s original text, branding, graphics, photographs, videos, designs, and educational materials belong to Love Social Media, Katie Love, or their respective licensors, and are protected by applicable intellectual-property laws. No ownership is transferred to you. Subject to these Terms, you may view the site and save a personal calendar reminder for your own lawful, noncommercial use.
  2. Except as permitted by law or written permission from the rights holder, do not reproduce, distribute, sell, license, publicly display, republish, or create derivative works from protected materials. Do not use names, likenesses, or marks to imply endorsement. Rights not expressly granted remain reserved. Nothing restricts fair use or other nonwaivable statutory rights.

Section 5. Acceptable use & feedback

  1. Do not interfere with site operation; submit malicious code, spam, or unlawful material; circumvent security or rate limits; attempt unauthorized access; harvest personal information; or use automated tools to burden the site or exploit its signup service. We may use reasonable technical measures to investigate and prevent misuse and comply with lawful requests.
  2. If you voluntarily send nonconfidential suggestions about the site, you permit us to use those suggestions without an obligation to pay or credit you. This permission does not transfer ownership of your personal information, grant a right to publish private correspondence, or authorize use of your name or likeness as a testimonial. Send copyright concerns with the relevant URL, an explanation of your rights, and contact information to hello@postthedamnthing.com.

Section 6. Information & results

  1. Site and course descriptions provide general educational information. They are not individualized legal, tax, financial, medical, or other professional advice. Seek qualified advice for your circumstances. We make no promise of earnings, audience growth, employment, business success, social-media reach, or any particular outcome. Results depend on circumstances, effort, platform changes, and other factors outside our control.
  2. Examples and testimonials, if used, reflect individual experiences and do not guarantee typical or future results. References to other services do not imply affiliation or endorsement unless stated. Third-party sites have their own terms and privacy practices. Review them before providing information or purchasing anything.

Section 7. Availability & warranties

  1. To the fullest extent permitted by applicable law, the site and waitlist are provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant uninterrupted availability, error-free content, complete security, delivery of every email, or compatibility with every device or third-party service.
  2. We may correct errors, change features, or suspend the site for maintenance, security, or business reasons. This does not excuse obligations imposed by law or any express written commitment we make. No disclaimer excludes a warranty or consumer protection that applicable law does not allow us to exclude.

Section 8. Liability & responsibility

  1. To the maximum extent permitted by law, Love Social Media, Katie Love, and their officers, employees, contractors, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, opportunity, goodwill, or data arising from use of this free site or waitlist. Their combined liability for claims concerning this free site or waitlist is limited to US $100.
  2. These limits do not apply to fraud, intentional misconduct, gross negligence, or liability that cannot lawfully be limited. Mandatory consumer rights remain intact. To the extent permitted by law, you are responsible for third-party claims and reasonable costs caused by your unlawful use, infringement of others’ rights, or material breach. This does not require you to indemnify anyone for their own wrongful conduct. Separate purchase terms govern paid services.

Section 9. Florida law & general terms

  1. Florida law governs these Terms, without regard to conflict-of-law rules, except where mandatory law applicable to you provides otherwise. Disputes may be brought before a Florida state or federal court with jurisdiction; this does not restrict any forum or remedy guaranteed to consumers by applicable law. You may contact us first to seek an informal resolution, without delaying a legal deadline or access to urgent relief.
  2. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a right is not a waiver. These Terms govern the website and waitlist relationship. We may assign them as part of a lawful business transfer without reducing mandatory protections. No agency, partnership, employment, or joint venture is created. We have not imposed mandatory arbitration or a class-action waiver.

II. Privacy Policy

Section 10. Privacy: information collected

  1. When you join, we collect your email address, a generated subscriber identifier, signup time, subscription preference record and version, subscription status, and welcome/launch delivery states. Our email provider may return message identifiers, delivery information, bounces, spam complaints, and unsubscribe events. If you contact us, we receive the information you include in that correspondence.
  2. Our waitlist application uses a keyed hash derived from the request IP address to limit abuse; it does not save the raw IP in its subscriber record. Hosting and delivery providers may separately process IP addresses, browser/device details, request logs, and security information to operate their services. Do not send sensitive personal information through the waitlist or general correspondence.

Section 11. Privacy: uses & legal bases

  1. We use information to administer the waitlist, send requested emails and related promotional materials, handle inquiries, maintain preferences, understand site performance, prevent fraud and abuse, troubleshoot delivery, meet legal obligations, and establish or defend legal claims. We do not use a waitlist signup as permission for every unrelated future purpose.
  2. Where laws require a legal basis, we rely on valid consent for promotional communications where required, legitimate interests for proportionate administration and security where permitted, and legal obligations where applicable. You may withdraw consent without affecting the lawfulness of earlier processing. If we introduce a materially different purpose, we will provide appropriate notice and obtain additional consent when required.

Section 12. Privacy: analytics & storage

  1. The live site is configured to use Vercel Web Analytics for aggregate usage measurement, such as page visits, referring sources, device/browser categories, and country-level trends. The current analytics service is designed to operate without advertising cookies. We do not intentionally send the email form’s contents to the analytics service. Local development previews do not load analytics.
  2. Your browser may store a session flag so the introductory animation does not repeat in the same tab session. This is not an advertising identifier. The current waitlist does not implement advertising pixels, cross-site behavioral advertising, or a public member directory. If optional tracking is added, we will update this notice and implement applicable preference or consent controls before using it.

Section 13. Privacy: sharing & transfers

  1. We use Vercel for hosting and private waitlist storage, and Postmark for email delivery when enabled. These providers process information needed to deliver, secure, and support their services. Authorized personnel and professional advisers may access information where reasonably necessary and subject to appropriate confidentiality obligations.
  2. We may disclose information when required by law, in response to a valid legal process, to protect rights and safety, or in connection with a merger, acquisition, financing, or sale of assets subject to applicable protections. We do not sell waitlist email addresses or share them for cross-context behavioral advertising. Providers may process information in the United States and other countries; required international-transfer safeguards must apply where applicable law requires them.

Section 14. Privacy: retention & security

  1. We keep subscriber information as reasonably necessary for the waitlist, requested communications, operational records, legal obligations, and resolving disputes. Retention depends on the purpose and applicable requirements; this site does not promise an automatic deletion date. We retain limited unsubscribe or suppression records as needed to prevent accidental re-enrollment, even when other information is deleted where appropriate.
  2. We use safeguards intended to limit unauthorized access, including private storage, access controls, signed unsubscribe links, and abuse limits. No system is completely secure, and we cannot guarantee absolute security. If an incident occurs, we will investigate and provide notices required by applicable law. Please notify us promptly if you believe your information has been misused.

Section 15. Privacy: your choices & rights

  1. You can unsubscribe from promotional emails at any time. Depending on your location and applicable law, you may also have rights to access, correct, delete, or obtain a copy of personal information; restrict or object to processing; withdraw consent; or appeal a decision about a request. Email hello@postthedamnthing.com with your request. We may proportionately verify identity or an authorized agent’s authority before acting.
  2. We respond within applicable legal periods, explain relevant exceptions, and do not unlawfully discriminate for exercising privacy rights. Some information may need to be retained for legal or suppression purposes. Where available, you may complain to your competent data-protection authority or other regulator. This notice does not claim that every state privacy statute applies to this business, and it does not reduce any rights you do have.

Section 16. Children, changes & contact

  1. The site is intended for adults, and we do not knowingly seek personal information from children under 13. If you believe a child has provided information, contact us so we can investigate and take appropriate action. Eligibility for the waitlist is 18 and older, regardless of that additional children’s privacy protection.
  2. We may update these Terms and this Privacy Policy and will revise the date below. Material changes will receive additional notice where required. Changes do not retroactively authorize new data uses or waive accrued rights. Additional consent will be requested when required. For website, legal, accessibility, or privacy questions, contact Love Social Media, Florida, at hello@postthedamnthing.com. Ask for a copy of this policy if you prefer another accessible format.
